1. Introduction
These Terms and Conditions ("Terms") govern your use of services provided by Ricardo Assumpcao Maciel trading as CAJUBR ("FlyParatrike", "we", "us", or "our"). By booking a course or service, you agree to be bound by these Terms.
Important: Paratrike is an adventure sport that carries inherent risks. By accepting these Terms, you acknowledge that you understand and accept these risks.

3. Services Offered
FlyParatrike offers the following paratrike services:
- CP Course (Club Pilot): Beginner course - £1,450
- EP Course (Elementary Pilot): Advanced beginner - £950
- Tandem Flights: Passenger experience - £150
- Refresher Training: Skills update - £350
- SIV Training: Safety maneuvers - £450
4. Booking and Payment
4.1 Booking Process
All bookings must be made through our website (flyparatrike.com) or by direct contact with us. A booking is confirmed only when full payment or deposit (as applicable) has been received and confirmed by us.
4.2 Payment Terms
- Full payment must be received at least 30 days before the course start date
- Alternative: Pay £500 deposit at booking, with balance due 30 days before course
- Payment methods: Credit/Debit card via Stripe, Bank Transfer
- All prices are in GBP (£) and include VAT where applicable
4.3 Late Payment
If full payment is not received 30 days before the course start date, we reserve the right to cancel your booking and offer your place to another client.
5. Cancellation and Refund Policy
5.1 Cancellation by Client
- More than 30 days before course: Full refund minus £50 administration fee
- 15-30 days before course: 50% refund
- Less than 15 days before course: No refund
- No-show: No refund
5.2 Cancellation by FlyParatrike
We reserve the right to cancel courses due to:
- Insufficient enrollment (minimum 2 students required)
- Unsafe weather conditions
- Instructor illness or emergency
- Force majeure events
In case of cancellation by us, you will receive a full refund or the option to transfer to an alternative date.
5.3 Weather Delays
Paratrike is weather-dependent. If weather conditions are unsuitable:
- Training will be postponed to the next suitable day
- Course dates may be extended at no extra cost
- No refunds for weather delays
- We aim to complete courses within the scheduled period, but cannot guarantee this due to weather
6. Health and Safety Requirements
6.1 Medical Requirements
All participants must:
- Be in good physical health
- Disclose any medical conditions that may affect their ability to fly
- Obtain medical clearance if requested
- Not fly if under the influence of alcohol or drugs
6.2 Age Requirements
- Minimum age: 16 years (with parental consent if under 18)
- Maximum age: No limit, subject to fitness assessment
6.3 Weight Restrictions
- Minimum weight: 50kg (110 lbs)
- Maximum weight: 110kg (242 lbs)
- Weight restrictions apply for safety reasons related to equipment limitations
7. Insurance Requirements
7.1 Mandatory Insurance
All course participants must have valid insurance covering:
- Personal accident and injury
- Third-party liability (minimum £1 million)
- Medical expenses
- Repatriation (if applicable)
7.2 Proof of Insurance
Proof of insurance must be provided at least 14 days before the course start date. Failure to provide valid insurance documentation may result in cancellation of your booking with no refund.
7.3 Insurance Recommendations
We recommend obtaining paratrike-specific insurance from providers such as:
- BHPA (British Hang Gliding and Paratrike Association)
- Insure4Sport
- SportsCover Direct
8. Acknowledgement of Risk
By accepting these Terms, you acknowledge that:
- Paratrike is an adventure sport that carries inherent and significant risks including serious injury or death
- Weather conditions can change rapidly and may create dangerous situations
- Equipment can fail despite regular maintenance and safety checks
- Human error by yourself, instructors, or other pilots can lead to accidents
- Landing areas may have obstacles including trees, power lines, buildings, vehicles, and uneven terrain
- You may experience physical discomfort including motion sickness, muscle strain, or fatigue
9. Limitation of Liability
9.1 Our Liability
You acknowledge and agree that:
- You participate in all activities entirely at your own risk
- We provide training and equipment in good faith but cannot guarantee your safety
- We are not liable for any injury, loss, or damage arising from your participation except where caused by our proven negligence
- We are not liable for weather-related delays or cancellations
- We are not liable for personal property damage or loss during activities
- Our liability is limited to the amount you paid for the course or service
- You release us from all claims related to your participation except those arising from our proven gross negligence
- You agree to indemnify us against third-party claims arising from your actions during training
9.2 Nothing in these Terms excludes liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any other liability that cannot be excluded by UK law
10. Code of Conduct
All participants must:
- Follow all instructions from instructors
- Behave respectfully towards instructors and other participants
- Not fly under the influence of alcohol or drugs
- Not fly if feeling unwell or unfit
- Respect local regulations and airspace restrictions
- Respect the environment and local community
We reserve the right to exclude any participant who:
- Behaves dangerously or recklessly
- Fails to follow instructor guidance
- Behaves abusively or disruptively
- Is under the influence of alcohol or drugs
No refund will be given in case of exclusion for misconduct.
11. Equipment
11.1 Our Equipment
- All equipment is maintained to manufacturer specifications
- Equipment is inspected before each use
- Paraglider wings are certified to EN or LTF standards
- Harnesses and reserves are packed by qualified personnel
11.2 Personal Equipment
You must bring:
- Sturdy boots with ankle support
- Warm, wind-resistant clothing
- Gloves
- Sun protection (sunglasses, sunscreen, hat)
11.3 Equipment Damage
You are responsible for any damage to our equipment caused by your negligence or misuse. Repair or replacement costs will be charged.
12. Photography and Media
By participating in our courses, you consent to:
- Being photographed or filmed during activities
- Use of your images for promotional purposes (website, social media, advertising)
- Use of your testimonials and feedback
If you do not wish to be photographed or have your images used, please inform us in writing before the course starts.
13. Data Protection
Your personal data is processed in accordance with our Privacy Policy and UK GDPR regulations.
14. Intellectual Property
All content on our website, including text, images, logos, and training materials, is the property of FlyParatrike or used with permission. You may not reproduce, distribute, or use this content without our written permission.
15. Complaints and Disputes
15.1 Complaints Procedure
If you have a complaint:
- Raise the issue with your instructor immediately if possible
- If unresolved, email us at caju@cajubr.com within 7 days
- We will investigate and respond within 14 days
15.2 Dispute Resolution
Any disputes will be governed by the laws of England and Wales. Both parties agree to attempt mediation before legal proceedings.
16. Force Majeure
We are not liable for failure to perform our obligations due to circumstances beyond our control, including:
- Natural disasters
- Government restrictions
- Pandemics or health emergencies
- War or civil unrest
- Strikes or labor disputes
17. Changes to Terms
We reserve the right to update these Terms at any time. Changes will be posted on our website with an updated "Last Updated" date. Your continued use of our services after changes constitutes acceptance of the new Terms.
18. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy and any booking confirmation, constitute the entire agreement between you and FlyParatrike.
